That proof will come from three different places. Your report, the other driver’s report and the police report, also, if there are any witnesses to the accident, their information will also be of consideration. An insurance adjuster would be assigned to come out and estimate your claim and the insurance company sends you a check that covers the cost of repairs.

When you are involved in an accident, you will need to collect all the information possible, including the driver of the other vehicle’s name, address, phone number, license number, driver’s license number and insurance information. Make sure you get a copy of the police report, or take down the number of the police report so you can obtain it later. In some areas, the police may resist filing an accident report, if this is the case, insist that they take the accident report, if they still resist, then ask for an incident report. You need a report from them in order to file your insurance claim.

If the other party is responsible for the accident, you still want to report it to your own insurance company, they are much better equipped to make sure the other carrier will cover any repairs, damage or bodily injury you were subjected to. Check with your insurance company before you do anything or talk to anyone, this will make them much easier to get along with as you will make their job easier.
